Dallas Construction Mediator
Construction Dispute Mediators in Dallas, Texas
Mediation can be a very effective way to resolve construction disputes without the need for a long, drawn-out trial. In fact, many judges will REQUIRE both parties to attempt mediation before they even allow a construction dispute to move to the courtroom.
To discuss your options with a Dallas construction mediator today, call Rasansky Resolution Center at (214) 275-5333 for a free consultation.
The purpose of mediating a construction dispute is to have a neutral third party (the mediator) listen to both sides of the argument, and help them find a resolution to the case if at all possible. In the construction industry, disputes can be damaging and expensive. For this reason, it’s usually in everyone’s best interests to try and resolve complex construction disputes early on. This is our goal at Rasansky Resolution Center.
Common Types of Construction Disputes
Construction disputes can be incredibly complex, and often involve many parties (business owners, contractors, subcontractors, construction managers, architects, designers, engineers, sureties, insurers, manufacturers, suppliers, lenders, consultants, accountants, etc).
While disputes can arise over a variety of issues, they commonly fall under one of the following categories:
- Project Delays – Project delays can threaten a project in terms of revenue, deadlines, and overhead. Delays can result in lost productivity, which can affect both owners as well as employees, contractors, and subcontractors.
- Quality of Work – Quality of labor or materials claims often arise when a contractor, subcontractor, or supplier fails to meet various standards of quality. These can include published design standards, industry standards (e.g. ASTM), or performance standards.
- Nonpayment – Claims of nonpayment (unpaid labor and/or materials) are probably the most-common source of disputes in the construction industry. Without a neutral third-party mediating the process, it can be difficult to impossible for both sides to effectively work toward a solution.
- Liens and Bonds – Lien perfection and bond claim requirements are cumbersome, complex, and unique to each state. Notice requirements are incredibly strict, and filing deadlines are often unforgiving.
